1. Collection of Personal Information
andeye may collect personally identifiable information necessary for the service to function. This includes:
- your operating system (OS), browser information, and access times to allow the andeye services to properly function and help prevent unauthorised access to your account
- your e-mail address, to respond to support inquiries, or allow you to gain access to your account if you forget your password
- your IP address, to help prevent unauthorised access to your account, and to uphold any bans placed upon you in chats, and comply with law enforcement
- the website that referred you to andeye, to analyse traffic and improve our services
Your personal information is only viewable to andeye’s owners, employees, or other contractors. This information will not be displayed to other users. This information will not be transmitted, distributed, or sold to any third parties, unless andeye must (a) conform to the edicts of the law or comply with legal process served on andeye or the site; (b) protect and defend the rights or property of andeye; or, (c) act under exigent circumstances to protect the personal safety of users of andeye, or the public.
If you purchase andeye’s products and services, your transaction may be handled by a third party. In this instance, your e-mail address and a user identification number will be transmitted to the third party payment processor.
Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through andeye to other user(s), they may collect this and distribute it to others, with or without your knowledge or consent. andeye will not be held responsible if other user(s) use content you willingly share with them against you. Similarly, andeye and presenters in any live broadcast may read out or repeat messages and questions that you post, which will then become part of the permanent public recording of the broadcast.
andeye allows users to link to external websites from within the chat. If you watch a live or recorded broadcast, listen to an in-chat radio, click external links, or engage with users off-site, andeye will not be held responsible for the privacy statements or other content on the external website(s).
Information provided by you, either automatically by your browser, or by content you submit, may be used by internal tools to enforce the Terms of Service, and uphold any account suspension(s).
2. Creation of Anonymous Data
We may create Anonymous Data records from Personal Information by excluding information (such as your username) that make the data personally identifiable to you. We use this Anonymous Data to analyse usage patterns so that we may enhance the content of our Services. We reserve the right to use Anonymous Data for any purpose and disclose Anonymous Data to third parties in our sole discretion.
3. Data Retention
andeye retains two types of data: temporary data, and permanent data. In most circumstances, temporary data is stored for up to six months before being erased, whereas permanent data will remain until removed by the user. In the event that temporary data may be needed for any legal purposes, or to record activity that violates the Terms of Service to uphold account suspension(s), temporary data may be retained permanently. Messages and questions sent within the chat or via email may be read or otherwise repeated along with the corresponding username during a live broadcast which may be retained permanently and publicly.
Temporary data includes:
- Messages sent within the chat, including direct messages
- IP address(es) used to access your account(s)
- Deleted image(s)
- Previous email address(es) associated with account(s)
Unless otherwise stated, all other information you submit to the service shall be considered permanent data. This includes, but is not limited to:
- Image uploads
- Usernames, existing email address(es), existing image(s), IP address used to create the account, IP address last used to sign in
- Account preferences and settings
- Support inquiries
4. Your Rights over your Information
You have the right to request a copy of the information stored about you. Requests must be filed to email@example.com with the subject “Access My Information”. There will be several steps to verify your identity and the legitimacy of the request, and, in some cases, an administrative fee may be required, before the data will be handed over. Under no circumstance may you attempt to retrieve data on other user(s) by impersonating them; doing so will be punished by the full extent of the law.
Users who believe they have a right by law to have their temporary data and/or permanent data destroyed may submit a request to firstname.lastname@example.org with the subject “Destroy My Information”. There will be several steps to verify your identity and the legitimacy of the request. This will only be done if required by law. Some information may be retained if it’s required to enforce the Terms of Service, if it’s required by law, if it is not considered “personal data”, and/or if it is required for accounting purposes.
andeye uses “cookies” to help keep you logged in to your account, store your nickname, and site preferences. Cookies may also be placed to help give analytics data of where the users are coming from, how long they use the service, and what pages they use.
You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the andeye services or websites you visit.
6. Security of your Personal Information
andeye takes good efforts to secure your personal information from unauthorised access, use, or disclosure, using SSL Protocol.
When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.
Due to the open communication nature of andeye, we cannot guarantee that communications to and from you and the site will be free from unauthorised access by third parties, including, but not limited to, computer malware on your device, software bugs in first- or third-party software, or other means of intercepting data. Users of the site use it at their own risk. We cannot guarantee the security of any information that is disclosed, public or private.
andeye allows users to submit Content (including, but not limited to, messages, pictures, audio, video, or hyperlinks) directly to one or more individuals. Any Content submitted to a user will be recorded by andeye, and will be treated as public under US and UK Law, regardless of any other phrasing, implied or unimplied, in the methods used to submit the Content. Other persons have the right to share Content you submit with anybody of their choosing, with or without your knowledge or consent. andeye is unable to stop a person from redistributing Content you shared with them.
7. Children and Teenagers
andeye does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of 18, you must ask your parent or guardian for permission to use this website. If you are under the age of 13, we are sorry but you must not use this website, please ask your parent/guardian or teacher to use the website for you.
8. Information Viewable In Your Account
You are responsible for the safe-guarding of your andeye account. If your password is guessed, phished, or otherwise obtained by another user, or if a device used to access andeye is physically or digitally tampered with, a perpetrator may be able to access your andeye account, with or without your knowledge. In doing so, they may be able to see content you have posted elsewhere on the site, including, but not limited to, your email address, name, or other personally identifiable information. To prevent this, you are expected to have a strong, secure password that is not used on any other site, and you are expected to keep your password, your email accounts, your personal devices, and your andeye account secure. andeye is not responsible for personally identifiable information being exposed due to your account being accessed by another user.
